El aumento continuado de las emisiones de gases de efecto invernadero y su concentración en la atmósfera, especialmente en los últimos cuarenta años, contrasta con las acciones tomadas tanto a nivel estatal como internacional desde la aprobación de la Convención Marco de Naciones Unidas sobre Cambio Climático en 1992. Frente a una acción climática claramente insuficiente, que pone en peligro la civilización humana tal como la conocemos, son cada vez más numerosos los litigios climáticos interpuestos contra los estados en sede judicial para obligarlos a adoptar políticas responsables. A este tipo de pleitos se unen otros tantos, que derivan de la diversidad de actores afectado, ya sea por la crisis climática o por las medidas que se toman para hacerles frente. El objetivo de este artículo es ofrecer un panorama de los litigios climáticos, especialmente desde 2015, haciendo especial hincapié en las tendencias más recientes de un campo en continua evolución.

The continuous increase in greenhouse gas emissions and their concentration in the atmosphere, especially during the last forty years, appears in stark contrasts to the actions taken both at the national and the international level since the adoption of the UN Convention on Climate Change in 1992. The utter insufficiency of climate action, that is driving human civilization to a tipping point, is increasingly fuelling a legal strategy to bring governments to court to force them to adopt a responsible climate policy. This is not the only kind of climate litigation, since the many actors affected by either the climate crisis or by the policies enacted to solve it have all engaged in some sort of judicial dispute against each other. The main goal of this article is to present an outlook of climate litigation since 2015, especially focusing on the more recent trends of a fast-evolving phenomenon.
