El trabajo aborda la respuesta del Derecho penal al fenómeno del cambio climático. Para ello, en primer lugar, se considera necesario la distinción entre clima y medio ambiente como bien jurídico protegido. El Derecho penal climático, conforme a esta distinción, tiene una fisonomía distinta y es independiente del Derecho penal del medio ambiente. A partir de aquí se estudian dos posibles modelos de conformar el Derecho penal del clima. El que se construiría de manera accesoria siguiendo la legislación climática y el formulado sobre la base de la afectación del cambio climático a los derechos humanos.
The paper addresses the response of criminal law to the phenomenon of climate change. To this end, it is first considered necessary to distinguish between climate and environment as a protected legal right. Climate criminal law, according to this distinction, has a different physiognomy and is independent of environmental criminal law. From this point, two possible models of shaping climate criminal law are studied. The one that would be constructed in an ancillary manner following climate legislation and the one formulated on the basis of the impact of climate change on human rights.
