Any public body should be empowered to be a qualified interpreter of theConstitution when complying with and enforcing legal texts, especially whennoting violations of constitutional principles that affect fundamental rights. However, when the conflict between the law and the Supreme Norm arose, theConstitutional Court backtracked in its initial position of entrusting the publicadministration with the exercise of diffuse control not to apply the law for contravening the Constitution (Constitutional Court, Sentence Nro. 3741-2004-AA/TC, 2006), arguing that said precedent distorts the scope of a competencegranted exclusively by the Constitution to the Judiciary, and that extendingits exercise to those who are not involved in the judicial function would implya dangerous new paradigm of power for the administrative collegiate bodies, deciding that only constitutional law is law (Constitutional Court, SentenceNro. 4293-2012-PA/TC, 2014).Currently, the Office of the Comptroller General of the Republic faces preciselythis dilemma, related to administrative sanctioning procedures in process underthe protection of Article 46 of Law No. 30742 (Law of Strengthening of theOffice of the Comptroller General of the Republic), which fully reproduced theprovisions of Article 46 of Law No. 29622 (Law that granted powers to the Comptroller’s Office to sanction in matters of functional administrative res-ponsibility) declared unconstitutional by the Constitutional Court in SentenceNo. 020-2015-PI / TC. This situation became more serious when, questionedabout the effects that the aforementioned sentence would have regarding thefacts that constitute infractions within the scope of the sanctioning powerof the Comptroller’s Office that occurred as of the entry into force of Law ofStrengthening, the highest interpreter of the Constitution, in its clarifying order, concluded that: “It has not issued any pronouncement on Law 30742” (SentenceNro. 00020-2015-PI/TC, Clarifying Order Nro. 4, Constitutional Court, 2019).Because of this, due to the silence of the Constitutional Court and without thepower to exercise diffuse control in administrative headquarters, the Comptroller’s Office would be obliged to comply with the legal mandate to exerciseits sanctioning power, but with a provision unconstitutional that violates theprinciples of legality and typicity, affecting the rights of those subject to itsadministrative sanctioning procedures.
