    En este artículo, se realiza un análisis sobre la situación actual de tutela y protección de los menores desamparados en España. Para comprender la materia del desamparo de menores, conviene precisar la diferencia entre los conceptos de riesgo y desamparo. En lo sucesivo, planteando varias problemáticas, es esencial hacer mención de tres aspectos importantes como son el principio de primacía del interés superior del menor tras la reforma del año 2015, el derecho del menor a relacionarse con su familia y el retorno del menor al núcleo familiar de origen.

    The aim of this article is to provide an analysis regarding the guardianship and the protection of helpless minors in Spain. In order to understand the issues regarding the helplessness of minors, it is necessary to differentiate between the concepts of "at risk" and "helplessness". Hereafter, presenting several issues, it is essential to mention three important aspects, which are the primacy of the best interest of the minor, the right of the minor to keep in touch with his family and the return of the minor to the original household.
