    A pesar de que finalmente la revisión realizada de la Directiva Solvencia II no haya abordado la previsión y elaboración de un régimen, aunque fuera mínimo, sobre un sistema de garantía de seguros aplicable a todo el espacio europeo, no cabe duda de que la implementación de instrumentos de este tipo resulta necesaria para profundizar en la protección de los asegurados, en particular, de los que resulten perjudicados por determinadas situaciones que afecten a las entidades aseguradoras, como puede ser su insolvencia. Un sistema de garantía obligatorio, equilibrado y homologable en los distintos Estados miembros implicaría apuntalar de modo significativo la estructura del mercado asegurador

    Although the fact that the review carried out of the Solvency II Directive has not finally addressed the provision and preparation of a system, albeit minimal, of an insurance guarantee system applicable to the entire European area, there is no doubt that the implementation of instruments of this type is necessary to deepen the protection of the insured, in particular, of those who are harmed by certain situations that affect insurance companies, such as insolvency. A binding, balanced and comparable guarantee system in the different Member States would imply significantly strengthening the structure of the insurance market.
