Resumen de Casuística práctica del delito de defraudación a la Seguridad Social del artículo 307 y del fraude de subvenciones del artículo 308 del Código Penal

Se analizan los delitos de la defraudación a la Seguridad Social del artículo 307 del CP, fraude de prestaciones de la Seguridad Social del artículo 307 ter del CP, y del fraude de subvenciones del artículo 308 del CP, como una de las corruptelas existentes en el título XIV del libro II del CP en cuanto a la actividad de personas que, lejos de llevar una conducta ordenada en cuanto a las subvenciones y ayudas que se reciben de la Administración pública, las dirigen a otros objetivos distintos, así como los que no cumplen con la Seguridad Social en sus obligaciones contributivas respecto de los trabajadores que con aquellos trabajan.

The crimes of Social Security fraud under article 307 CP and subsidy fraud are analyzed as one of the existing corruptions in title XIV of book II of the CP in terms of the activity of people who, far from having an orderly conduct in terms of subsidies and aid received from the public Administration direct them to other different objectives, as well as those that do not comply with Social Security in their tax obligations with respect to the workers who work with them.
