Resumen de Inteligencia artificial y robotización judicial: su impacto en nuestro sistema de justicia

La inteligencia artificial y su aplicación en el ámbito procesal es una cuestión de plena actualidad, pese a la falta de regulación expresa sobre esta materia. Entre otros usos, la inteligencia artificial puede estar orientada a la función jurisdiccional, es decir, como una ayuda en la toma de decisiones judiciales o incluso para adoptar decisiones automatizadas. Partiendo de esta base, analizamos la figura del juez-robot y su posible encaje en el proceso jurisdiccional actual, en tanto que afecta a principios clave como la independencia judicial y el deber de motivación. Finalizamos con unas conclusiones en las que trataremos de dilucidar si la inteligencia artificial puede sustituir el trabajo del juez.

Artificial intelligence and its application in the procedural field is a highly topical issue, despite the lack of express regulation on this matter. Among other uses, artificial intelligence can be oriented to the jurisdictional function, that is, as an aid in judicial decision-making or even to adopt automated decisions. Starting from this basis, we analyze the figure of the robot-judge and its possible fit in the current jurisdictional process, insofar as it affects key principles such as judicial independence and the duty to state reasons. We end with some conclusions in which we will try to elucidate whether artificial intelligence can replace the work of the judge.
