Resumen de Consideraciones sobre la necesidad de la aplicación de la mediación al régimen de comunicación de los progenitores con sus hijos

  En el presente trabajo se abordó la temática sobre la aplicación de la mediación a las reglas de comunicación entre los progenitores y sus hijos, partiendo de la definición y características del régimen de comunicación, la regulación de este régimen en algunos países de América Latina y en España y en nuestro ordenamiento jurídico. De esta forma se analizaron las posibilidades de aplicación de la mediación a esta institución del Derecho de Familia y se ejemplificó con un caso práctico esta posibilidad. Por último se concluye que es posible aplicarle la mediación a las reglas de comunicación entre padres e hijos, pues este método alternativo permite que las partes sean los protagonistas y arriben a un acuerdo que permita restablecer las relaciones familiares y contribuir al interés superior de los menores.PALABRAS CLAVE: Relaciones paterno-filiales; comunicación; interés superior del menor; mediación familiar.

  CONSIDERATIONS ON THE NEED FOR THE APPLICATION OF MEDIATION TO THE REGIME OF COMMUNICATION OF THE PROGENITORS WITH THEIR CHILDRENABSTRACTThis paper deals with the issue of the application of mediation to the rules of communication between parents and their children, based on the definition and characteristics of the communication regime, the regulation of this regime in some Latin American countries and in Spain and in our legal system. In this way, the possibility of applying the mediation to this institution of Family Law is analyzed, and this possibility is exemplified by a practical case. Finally, it is concluded that it is possible to apply mediation to the rules of communication between parents and children, because this alternative method allows the parties to be the protagonists and reach an agreement that allows restoring family relationships and contributing to the best interests of the children.KEYWORDS: Parental relationships; communication; superior interest of the child; family mediatio.
