  Tras la entrada en vigor de la Ley 8/2021, de 2 de junio, en materia de discapacidad, el Tribunal Supremo ha dado a luz a un primer pronunciamiento sobre la misma. Este comentario, además de analizar cómo lidia con el nuevo sistema de apoyos, resalta alguna de las lagunas legales existentes en la Ley 41/2002, de 14 de noviembre, de Autonomía del Paciente, ante la falta de su modificación a la vista de la nueva reforma en discapacidad.

  After the entry into force of Law 8/2021, of June 2, on disability, the Supreme Court has given birth to a first pronouncement on it. In this commentary, in addition to analyzing how it deals with the new support system, the existing legislative gaps in Law 41/2002, of November 14, on Patient Autonomy, are highlighted, in the absence of its modification in view of the new disability reform.
