Resumen de Adaptación y persistencia del sistema penal en el distrito judicial de Querétaro, México. Una mirada desde la cultura jurídica

  Se presenta un análisis de la cultura jurídica del campo penal queretano y su papel frente a los cambios sociales a partir de la experiencia de la reforma para implementar el sistema acusatorio y oral. A partir de una etnografía en juzgados de oralidad penal del distrito judicial de Querétaro, se advierte que desde la performance legal y la interpretación de la ley se mantienen las fronteras con la sociedad como una vía para la persistencia del campo jurídico. En el primer apartado se presenta la noción de cultura jurídica y cambio social, en el segundo se exponen los mecanismos de adaptación del campo jurídico, en el tercero nos concentramos en la cultura jurídica interna y proponemos una vía de análisis que combina la performance y el expediente judicial para el estudio del cambio legal.

  We present an analysis of the legal culture of the penal field and its role in social changes, such as the reform for the implementation of the accusatory and oral system. From an ethnography in oral courts of the judicial district of Queretaro, we noted that the legal performance and the interpretation of the law maintained the borders with society, as a way for the persistence of the legal field. In the first section the notion of legal culture and social change is presented, in the second the mechanisms of adaptation of the legal field are exposed, and in the third we focus on the internal legal culture, and propose an analysis that combines performance and the judicial file for the study of legal change.
