Recently the Strasbourg Court affirmed the violation of Art. 6 ECHR in the case of a man drawn from evidence of guilty, who was heard as a witness during the investigation, without the assistance of a lawyer and without the possibility of refraining from responding. The case provides the opportunity to reflect on similar practices applied also in our Country and on the impossibility of using the statement thus collected.
Di recente la Corte di Strasburgo ha affermato la violazione dell’art. 6 C.e.d.u. nel caso di un uomo che, pur attinto da indizi di reità, nel corso delle indagini veniva sentito in qualità di teste e, quindi, senza l’assistenza di un difensore e senza potersi astenere dal rispondere. Il caso fornisce l’occasione per riflettere su analoghe pratiche in uso nel nostro Paese e sull’impossibilità di usare le dichiarazioni così raccolte.
