Terrorism and cyber threats require increasingly considerable interaction between criminal justice and intelligence.
This osmosis has led to a lowering of the threshold of criminal proceedings and the creation of common investigation bodies.
The need to make collaboration and coordination more streamlined and efficient has prompted first the European legislator, and then the national one, to intervene, with choices that are not always harmonious and linear.
The purpose of this research is to outline the state of the art and to sketch some foreseeable criticalities, due to the lack of adequate legislation for the investigative reality produced by the contrast to today’s dangers.

Il terrorismo e le minacce cibernetiche richiedono una sempre più considerevole interazione tra giustizia penale e intelligence.
Questa osmosi ha determinato l’arretramento della soglia del procedimento penale e la creazione di organismi comuni di indagine.
L’esigenza di rendere più snella ed efficiente la collaborazione e il coordinamento investigativo ha spinto il legislatore europeo prima, e quello nazionale poi, ad intervenire, con scelte non sempre armoniche e lineari.
La ricerca ha l’intento di delineare lo stato dell’arte e di abbozzare possibili criticità, in ragione della mancanza di una normativa adeguata alla realtà investigativa prodotta dal contrasto ai pericoli odierni.
