Resumen de ¿Políticos o judiciales? Trayectorias ex ante y ex post de los exjueces de cuatro cortes constitucionales latinoamericanas (2000-2015)

Resumen Se ha escrito poco sobre las carreras profesionales de quienes integran las instituciones del poder judicial, y existe menos de las trayectorias políticas de exmagistrados constitucionales, pese a que integran espacios con una alta visibilidad política. Por ello la investigación responde ¿en qué medida las cortes constitucionales incentivan el desarrollo de carreras políticas antes y después? Mediante un análisis cuantitativo se identifica de dónde vienen y a dónde van los exjueces constitucionales de cuatro países de Latinoamérica. En los resultados se pudo observar que a las cortes constitucionales llegan algunos políticos y que, tras su salida de la institución, regresan a la carrera política. Así también, los datos evidencian que la carrera judicial no alcanza ni el 40% de los magistrados, lo que permite abrir una discusión sobre el perfil profesional de quienes integran las cortes, y con ello el análisis del comportamiento judicial.

Abstract Little has been written about the professional careers of those who make up the institutions of the judiciary, and there is less about the political trajectories of former constitutional magistrates, even though they are members of highly visible political arenas. For this reason, the research answers the question: to what extent do constitutional courts encourage the development of political careers? A quantitative analysis identifies where former constitutional judges in four Latin American countries come from and where they go. The results show that some politicians join the constitutional courts and that, after leaving the institution, they return to political careers. The data also shows that the judicial career does not reach even 40% of the judges, which opens a discussion on the professional profile of those who make up the courts, and with it the analysis of judicial behavior.
