    Con la evolución tecnológica han surgido nuevas formas de delinquir mucho más complejas y extensas que las existentes anteriormente, de forma que no solo se facilita la comisión del delito, sino que este puede perpretarse en cualquier parte, e incluso en varios lugares a la vez. En el ámbito tecnológico, la inteligencia artificial tiene una doble virutalidad en el ámbito penal, por una parte, facilita nuevas formas de delinquir, pero por otra, también puede ser muy efectiva en la prevención e investigación del delito. Desde esta perpectiva, el Convenio de Budapest es un instrumento muy relevante, no solo por ser el primer tratado internacional de origen europeo, sino porque contiene medidas de carácter sustantivo, procesal y jurisdiccional con la finalidad de crear una política penal común frente a la ciberdelincuencia.

    With technological evolution, new forms of crime have emerged that are much more complex and extensive than those that previously existed, so that not only is the commission of the crime easier, but it can be perpetrated anywhere, and even in several places at the same time. In the technological field, artificial intelligence has a double virutality in the criminal field, on the one hand, it facilitates new forms of crime, but on the other, it can also be very effective in the prevention and investigation of crime. From this perspective, the Budapest Convention is a very relevant instrument, not only because it is the first international treaty of European origin, but also because it contains measures of a substantive, procedural and jurisdictional nature with the aim of creating a common criminal policy against cybercrime.
