When a company agrees with a worker for early partial retirement, the employer is obliged to hire a relief worker, at least for the reduced working hours for the partial retiree, either with an indefinite relief contract, or with a temporary relief contract. determined, in the latter case having as end date that in which the partial retiree reaches the corresponding ordinary retirement age. Thus, points 6 and 7 of article 12 of the ETT Workers’ Statute) establish: So that the worker can access partial retirement, in the terms established in the consolidated text of the General Social Security Law and other concordant provisions , you must agree with your company a reduction in working hours and salary of between a minimum of twenty-five percent and a maximum of fifty percent and the company must simultaneously agree on a relief contract, in accordance with the provisions of the following section, with purpose of substituting the working day left vacant by the worker who is partially retiring…. The replacement contract will be adjusted to the following rules: a) It will be held with a worker who is unemployed or who had an agreed-upon contract with the company. determined duration. As can be seen, the wording of the ETT is very succinct and concise. So it has been the jurisprudence and the administrative criteria of the National Social Security Institute (INSS) that have been clarifying what should be understood, on the one hand, as an unemployed worker, and on the other, as a worker who has an agreement with the company a fixed-term contract. Throughout the following pages we will try to shed light on these two indeterminate legal concepts.
