Resumen de Los principios del Derecho del Trabajo:: Fundamento y actualidad del principio protector

El presente artículo tiene como objetivo formular algunas aproximaciones teóricas sobre los principios del Derecho del Trabajo vinculando sus funciones y contenido protector a su vigencia y eficacia actual. Su abordaje está dividido en tres ejes fundamentales para su mejor comprensión. El primero está destinado a los principios generales del derecho: su conceptualización, diferencia con otras fuentes del derecho y la evolución de su función normativa. El segundo apartado busca adentrarse más precisamente en el principio protector y su fundamento a través de tres preguntas básicas (¿a quién se protege? ¿por qué? ¿cómo lo hace?), para luego pasar a describir someramente el proceso de su recepción legal, constitucional y jurisprudencial en nuestro sistema normativo. El último eje, por su parte, estará destinado a brindar un pantallazo general sobre el presente del sistema de protección y algunas de las principales limitaciones con las que cuenta para cumplir con su objetivo.

The objective of this article is to formulate some theoretical approaches to the principles of labor law, linking its functions and protective content to its current validity and effectiveness.
Its approach is divided into three fundamental axes for its better understanding. The first is aimed at general principles of law: its conceptualization, difference from other sources of law and the evolution of its normative function. The second section seeks to the protective principle and its foundation, through three basic questions: who is protected? Why? And how does it do it? And then go to a briefly describe of process of its legal, constitutional, and jurisprudential reception in our regulatory system. The last axis, for its part, will be destinated to provide a general overview of the present protection system and some of the main limitations it has fulfill its objective.
