El presente trabajo tiene por objeto analizar el origen y la evolución jurisprudencial que han experimentado los distintos impuestos sobre los grandes establecimientos comerciales creados por las Comunidades Autónomas, hasta llegar a su enjuiciamiento por el Tribunal de Justicia de la Unión Europea, quien finalmente terminó reconociendo que el establecimiento de un tributo que grava por razones medioambientales y urbanísticas las superficies comerciales de más de una determinada superficie no contraviene el Derecho de la Unión Europea (y, en particular, la libertad de establecimiento), no constituyendo una ayuda de Estado.
The purpose of this paper is to analyze the origin and jurisprudential evolution that the different taxes on the large commercial establishments created by the Autonomous Regions have experienced, until they are prosecuted by the Court of Justice of the European Union, who finally ended up recognizing that the establishment of a tax that taxes commercial and environmental areas for commercial areas of more than a given area does not violate the law of the European Union (and, in particular, the freedom of establishment), not constituting an State aid.
