La Ley 2/2020 de 27 de julio modificó el artículo 324 de la LECrim en varios extremos, siendo el más debatido de ellos la limitación del valor de las diligencias acordadas fuera del plazo de instrucción establecido. Pese a la aparente claridad del precepto, la jurisprudencia está dividida respecto del tratamiento que merecen tales diligencias: ¿irregularidad limitada al momento concreto? o ¿nulidad y expulsión? La incerteza todavía es mayor cuando la diligencia acordada extemporáneamente es la propia declaración del investigado, pues podría llevar aparejada la imposibilidad de continuar el procedimiento contra el sujeto investigado o, en su caso, la absolución del mismo en sede de juicio oral.
Law 2/2020 of July 27 modified article 324 LECrim in several aspects. The most discussed of them is the limitation of the value of the evidence agreed outside the established period of investigation. Despite the apparent clarity of the article, the rulings on the Courts are divided as to the treatment that such evidences deserve: irregularity limited to the specific moment or nullity and expulsion of the entire proceeding? The uncertainty is even greater when the evidence agreed extemporaneously is the statement of the investigated, since this irregularity could lead to the impossibility of continuing the proceedings against the investigated person or his acquittal in the trial.
