  La Sala Cuarta del Tribunal Supremo señala que no procede reconocer el complemento de la prestación por IT derivada de accidente de trabajo establecida en el convenio colectivo de aplicación en los períodos de aislamiento o contagio a consecuencia del COVID-19. El convenio interpretado no podía prever la situación provocada por la pandemia, por lo que interpretarlo en un sentido positivo a la aplicación del complemento supondría una interpretación extensiva inadmisible. Por otra parte, el artículo 5 del Real Decreto-Ley 6/2020 asimila el aislamiento o contagio por COVID-19 a accidente de trabajo, pero únicamente a efectos de la prestación económica de IT.

  The Fourth Chamber of the Supreme Court states that it is not appropriate to recognise the supplement to the TL benefit derived from an accident at work established in the applicable collective agreement for periods of isolation or contagion as a result of COVID-19. The agreement as interpreted could not foresee the situation caused by the pandemic, therefore interpreting it in a positive sense for the application of the supplement would be an inadmissible extensive interpretation. Moreover, Article 5 of Royal Decree-Law 6/2020 assimilates isolation or contagion by COVID-19 to an accident at work, but only for the purposes of the TL benefit.
