Il presente contributo intende svolgere una riflessione sugli effetti della cessione del credito nei confronti del debitore che abbia serbato silenzio dopo la notifica prevista dall’art. 1264 c.c. Ricondotto lo schema negoziale della cessione ai negozi avente struttura bilaterale (e solo eventualmente trilaterale) e ridimensionata la portata dell’accettazione e della notifica come atti idonei a determinare esclusivamente l’esattoadempimento del debitore ceduto, si esclude che il contegno omissivo integri un riconoscimento del debitoai sensi dell’art. 1988 c.c.
This paper intends to propose some considerations regarding the effects of credit assignment on the debtor who has not manifested consent after receipt of the notification required by art. 1264 of Italian Civil Code. After having delimited the negotiating pattern at the assignment of juristic acts having bilateral structure (and, only optionally, a trilateral one) and after having reduced the scope of acceptance and notification as acts eligible to exclusively determine the exact fulfilment by the debtor, the possibility that silence constitutes the recognition of the debt in accordance with the art. 1988 of Italian Civil Code is excluded.
