Resumen de Las garantías constitucionales en los estados de emergencia: (SSTC 148/2021, 168/2021, 183/2021)

El objeto de este trabajo es analizar las sentencias del Tribunal Constitucional dictadas con motivo de los estados de alarma durante la crisis de la covid-19 y tratar de justificar que la Constitución española de 1978 contiene cinco garantías constitucionales en los estados de emergencia. El respeto a esas garantías ha de ser prioritario en la interpretación y aplicación de las normas reguladoras de estos. Esas cinco garantías se contienen en los arts. 55.1 y 116 CE y se traslucen en las sentencias del Tribunal Constitucional sobre los estados de alarma.

The purpose of this paper is to analyze the judgments of the Spanish Constitutional Court issued on the occasion of the states of alarm during the COVID-19crisis and try to justify that the Spanish Constitution of 1978 contains five constitutional guarantees in states of emergency. Respect for these guarantees must be a priority in the interpretation and application of the regulations governing the states of emergency. These five guarantees are contained in arts. 55.1 and 116 CE and, are revealed in the rulings of the Constitutional Court on the states of alarm.
