Una de las disputas más resonantes en las últimas décadas ha sido el Conflicto Malvinas-Falkand, cuyo marco reivindicatorio, constituido principalmente a partir de los reclamos de soberanía por parte de la Argentina respecto a las islas, ha sido motivo de distintas resoluciones de Naciones Unidas. En ese sentido, el presente trabajo analizará algunos de los episodios más ilustrativos del conflicto, en especial los que atañen a sus aspectos naval y terrestre, con la finalidad de observar ?según el relato de distintos testimonios? las infracciones al Derecho Internacional Humanitario que habrían cometido ambas partes en el transcurso de la disputa, a pesar de haber consentido gran parte de sus preceptos. Para ello, entonces, resulta necesario reparar en los principales tratados en la materia, sin dejar de advertir, tampoco, la connotación significativa de la costumbre en esta rama del derecho internacional.
One of the most resounding disputes during the last decades has been the Malvinas-Falkand Conflict, whose claiming framework –consisted mainly of Argentina ́s claims of sovereignty over the islands– has been the reason for many of the resolutions of United Nations. In this sense, the objective of the work that we propose to carry out is to analyze some of the most illustrative episodes of the confl ict, in particular those concerning its naval and terrestrial aspects, in order to observe –according to the account of diff erent testimonies– the violations to the core precepts of International Humanitarian Law that would have been breached by Argentina and The United Kingdom of Great Britain in the course of the dispute. To this end, we are fousing not only on principal treaties of International Humanitarian Law, but also in the signifi cant role that plays international custom in this fi eld of law
