Desde 2014 entró en funcionamiento el Tercer Tribunal Ambiental con competencia especial para aquellas materias ambientales que se promuevan desde la región del Bio Bio al sur. Sin embargo, personas naturales o jurídicas de origen mapuche continuaron a presentar recursos de protección constitucional invocando la garantía del Nº 8 del artículo 19, del derecho a vivir en un medio ambiente libre de contaminación, impetrados ante las Cortes de Apelaciones, con discreto éxito, lo que lleva a preguntarse si aún resulta pertinente impetrar este recurso de protección. La recopilación de sentencias permitió conocer las demandas ambientales desde los propios mapuche y establecer en qué casos claramente sobrevive la acción constitucional y cómo encontraríamos otros en los que pudiera comenzar a ser acogida.

Since 2014, the Third Environmental Court enter into operation with special jurisdiction for those environmental matters that are promoted from the Bio Bio region to the south. However, natural or legal persons of Mapuche origin continued to file protection constitutional appeals invoking the guarantee of No. 8 of Article 19, of the right to live in a pollution-free environment, petitioning the Courts of Appeals, with modest success, which leads to the question of whether it is still pertinent to request this protection appeals. The compilation of sentences allowed knowing the environmental demands from the Mapuche themselves and establishing in which cases the constitutional action clearly survives and how there would be others in which it could begin to be accepted.
