¿Son los jueces constitucionales guardianes sustantivos?

    Analizar las cualidades sustantivas del juez constitucional en el constitucionalismo contemporáneo no es una tarea sencilla; sin embargo, representa un estudio de suma importancia y valía para el Estado constitucional de Derecho. La actuación primigenia en la protección integral de normas sustantivas, el efecto reparador in integrum ante posibles violaciones y la visión expansiva y maximizadora para una tutela integral de derechos fundamentales, son solo algunos aspectos que renuevan el estatus del juez constitucional.

    Por otro lado, la creación de nuevos derechos en la judicatura constitucional a través de la interpretación evolutiva y el actuar interamericano del juez constitucional a partir de la constitucionalización del derecho internacional de los derechos humanos, son dos elementos distintivos de su conformación contemporánea y de su labor de protección integral por cuanto hace al ejercicio de derechos fundamentales.

    Por tanto, es válido presumir que el juez constitucional adquiere un enfoque preferente en los sistemas jurídicos contemporáneos, dado que representa el trascendental agente encargado de velar por el cumplimiento irrestricto y efectivo de los derechos, libertades y principios reconocidos en el constitucionalismo contemporáneo.

    Analyzing the substantive qualities of the constitutional judge in contemporary constitutionalism is not an easy task; however, it represents a study of great importance and value for the constitutional rule of law. The primary action in the integral protection of substantive norms, the reparative effect in integrum before possible violations and the expansive and maximizing vision for an integral protection of fundamental rights, are only some aspects that renew the status of the constitutional Judge.

    On the other hand, the creation of new rights in the constitutional judiciary through the evolutionary interpretation and the inter-American action of the constitutional judge on the basis of the constitutionalization of international human rights law are two distinctive elements of its contemporary composition and its work of comprehensive protection in terms of the exercise of fundamental rights.

    Therefore, it is valid to assume that the constitutional judge takes a preferential approach in contemporary legal systems since he represents the transcendental agent responsible for ensuring the unrestricted and effective fulfilment of the rights, freedoms and principles recognized in contemporary constitutionalism.
