Bioética y psicoterapias virtuales: Articulaciones y entrecruzamientos problemáticos

    El presente artículo aborda los problemas bioéticos que se presentan a raíz de la utilización de dispositivos virtuales en psicoterapia. Primero se expone una aproximación conceptual de esta modalidad de ejercicio profesional, para luego analizarla en función de los principios bioéticos expresados en la Declaración Universal sobre Bioética y Derechos Humanos de la UNESCO. La metodología elegida es de carácter cualitativo, y el método, hermenéutico crítico, aplicado a casuística existente. Entre las principales conclusiones que arroja el trabajo se destacan como problemas centrales la vulneración de derechos y garantías, tanto de profesionales como de usuarios, el acceso al sistema de salud mental, la seguridad del dispositivo y de los datos y el acceso a un servicio confiable y de calidad, lo que le otorga al dispositivo el carácter de fármacon:

    posible remedio -tecnología del yo-, posible veneno -tecnología de poder. Estas condiciones colocan en la figura del profesional la responsabilidad de llevar a cabo un análisis reflexivo y crítico que anteceda al uso y pueda ponderar valores, principios, derechos, legislaciones y formaciones, evaluando las situaciones en su singularidad, para delinear un proceder pertinente, basado en el resguardo de los derechos humanos.

    Dieser Artikel befasst sich mit den bioethischen Problemen, die sich aus dem Einsatz von virtuellen Dispositiven in der Psychotherapie ergeben. Zunächst wird ein konzeptioneller Ansatz für diese Form der Berufspraxis vorgestellt, und dann wird sie im Hinblick auf die bioethischen Grundsätze analysiert, die in der Allgemeinen Erklärung der UNESCO über Bioethik und Menschenrechte zum Ausdruck kommen. Die gewählte Methodik ist qualitativ und mit einem kritisch-hermeneutischen Interpretationsvorgehen auf die bestehende Kasuistik angewandt. Zu den wichtigsten Schlussfolgerungen der Studie gehören die Verletzung von Rechten und Garantien sowohl der Fachleute als auch der Patienten, der Zugang zum System der psychischen Gesundheit, die Sicherheit des virtuellen Dispositivs und der Daten und der Zugang zu einem vertrauenswürdigen und qualitätssicheren Dienst, was dem Dispositiv die Charakteristik eines Pharmakons verleiht: ein mögliches Heilmittel – Technologie des Selbst –, ein mögliches Gift – Technologie der Macht. Diese Bedingungen legen dem Fachmann die Verantwortung auf, vor dem Einsatz des Dispositivs eine reflexive und kritische Analyse durchzuführen, um Werte, Prinzipien, Rechte, Richtlinien und Wissensstände zu gewichten, wobei die Situationen in ihrer Einzigartigkeit bewertet werden, um ein angemessenes Verfahren auf der Grundlage des Schutzes der Menschenrechte zu entwickeln.

    This paper approaches some main bioethical issues in the context of the use of virtual devices in psychotherapy. First, we will elaborate a conceptual framework of this form of professional practice, in order to analise it regarding the bioethical principles found in the Universal Declaration on Bioethics and Human Rights of UNESCO. The methodology is qualitative and with a criticalhermeneutical method of interpretation applied to existing casuistry. Among the main conclusions of this paper it is important to highlight those regarding the main problems of vulneration of rights and guarantees, both of professionals and patients, the access to mental health system, the security of the device and data and the access to a trustworthy service of quality, which provides the device the characteristic of a pharmacon: a possible cure – technology of self -, a possible poison – technology of power. These conditions place in the figure of the professional the responsibility of developing a reflexive and critical analysis prior to the use of the device, in order to weight values, principles, rights, policies and formations, evaluating situations in their singularity, so to draw a proper procedure based in the protection of Human Rights.
