Reflexiones sobre la ciberdelincuencia en Europa y en el mundo: Instrumentos internacionales que abordan la ciberdelincuencia

    Ciberdelincuencia, cibercrimen, ciberdelitos… hacen referencia a una realidad, que, aunque no sea palpable, convive con nosotros a diario y tiene potencial para hacer daño, mucho daño tanto a nivel personal (suplantaciones de identidades, robos de contraseñas, extorsiones por la red, estafas bancarias y similares) como a nivel institucional (malware, phising, inyección de SQL(*)…) Hoy en día el cibercrimen genera más beneficios que el narcotráfico o la prostitución y por eso crece exponencialmente. Se hace, pues, necesaria una verdadera cultura de ciberseguridad desde todos los puntos de vista, desde la mujer que es ciberamenazada por su expareja, hasta las grandes infraestructuras nacionales que reciben diariamente decenas de ciberataques.

    El convenio de Budapest ha sido la herramienta clave para marcar a nivel internacional los pasos que debe seguir cada estado a la hora de perseguir los ciberdelitos, proporcionando un marco legal para la cooperación internacional y una guía común de medidas para detectar y perseguir a los ciberdelincuentes. Pero también hay otros instrumentos y protocolos de vital importancia que examinan los autores a lo largo de este artículo, tal son la Convención de Ciberdelincuencia de UN, actualmente en fase de Comité de Expertos, como diversas Directivas europeas y organismos creados para intentar prevenir y, en su caso, paliar los ciberataques.

    Cybercrime refers to a reality that, although not palpable, lives with us every day and has the potential to do harm, a lot of harm, both on a personal level (identity theft, password theft, network extortion, banking scams and the like) as well as at an institutional level (malware, phishing, SQL injection…).

    Cybercrime, nowadays, generates more profit than drug trafficking or prostitution and that is why it grows exponentially. A true culture of cybersecurity is therefore necessary from all points of view, from the woman who is cyber threatened by her ex-partner, to the large national infrastructures that receive dozens of cyber attacks daily.

    The Budapest Convention has been the key tool to mark at the international level the steps that each state must follow when prosecuting cybercrimes, it will need a legal framework for international cooperation and a common guide of measures to detect and prosecute cybercrimes. cyber criminals. But there are also other instruments and protocols of vital importance that the authors examine throughout this article, such as the UN Cybercrime Convention, currently in the Expert Committee phase, as well as various European Directives and organizations created to try to prevent and, where appropriate, mitigate cyberattacks.
