    Con motivo de los “linchamientos” de los detenidos en Latinoamérica, este trabajo se concentra en la detención que pueden realizar los particulares en el contexto de un delito flagrante. El artículo permite conocer sus características fundamentales y tener una referencia sobre algunas regulaciones en Latinoamérica y Europa. A partir de ese momento se alcanza la parte central del texto. Se trata de un importante debate en la doctrina procesal y penal alemana sobre (a) el problema del hecho que justifica una detención por particulares y (b) el problema de la legítima defensa del detenido cuando ha sido detenido por error. Finalmente, expongo mi opinión sobre los aspectos positivos y negativos del debate alemán.

    On the occasion of the “lynching” of detainees in Latin America, this paper focuses on the red handed arrest that can be made by private individuals. The article allows to know its fundamental characteristics and to have a reference on some regulations in Latin America and Europe. From this point on, the central part of the text is reached. It deals with an important debate in the German procedural and criminal doctrine on (a) the problem of the fact that justifies an arrest by private individuals and (b) the problem of the legitimate defense of the detainees when they have been arrested by mistake. Finally, I express my opinion on the strengths and weaknesses of the German debate.
