The paper addresses constitutional and international law profiles of the waiver of intellectual property rights on vaccines. It emphasizes the nature of common (or public, or social) good of the vaccine and, consequently, the obligation for public authorities of the Member States and the European union to take action so that the objectives of vaccination are achieved, not only at EU level, but globally, in the not distant perspective of a global treaty on pandemics.
