Resumen de Curatela versus tom ada de decisão apoiada: a capacidade civil como instrumento de garantia da autonomia da pessoa com deficiência

  This article aims to respond to the following research problem: according to the decisions of the Court of Justice of the State of São Paulo and legal provisions regarding supported decision making (TDA) in substitution of guardian-ship, would the reassignment of the interpretation of civil capacity promoted by the Statute for Persons with Disabilities be effective in guaranteeing the autonomy of the person with disabilities? Consequently, it is necessary to understand what is the legal status of disabled persons after the approval of the Disabled Persons Statute, what is the degree of protection that arises from the curren rules regarding civil capacity and how guardianship and supported decision making can influence the autonomy of this persons. The methodology applied in this study is bibliographic, pure in terms of results, with descriptive nature and adopts a quantitative and qualitative approach, through the use of the decision analysis method, in which judgments of the Court of Justice of São Paulo concerning guardianship and supported decision making are examined. It was observed that even with some controversies in the application of the Statute and the Civil Code and the lack of norms that enable better enforcement of the supported decision making, judicial decisions examined recognized the autonomy of persons with a disability, favoring greater inclusion in society.

  Este artigo se propõe a responder ao seguinte problema de pesquisa: de acordo com as decisões do Tribunal de Justiça do Estado de São Paulo e a inserção legal da tomada de decisão apoiada em substituição ao instituto da curatela, seria a redesignação da interpretação da capacidade civil promovida pelo Estatuto da Pessoa com Deficiência eficaz na garantia da autonomia da pessoa com deficiência? Assim sendo, é necessário entender a situação jurídica da pessoa com deficiência após a vigência do Estatuto da Pessoa com Deficiência, qual o amparo decorrente da atual regra de capacidade civil e como os institutos da curatela e tomada de decisão apoiada podem influenciar a autonomia dessa pessoa. Para isso, a metodologia adotada neste estudo é do tipo bibliográfico, puro quanto aos resultados, de natureza descritiva e a abordagem é quantitativa e qualitativa, mediante o uso do método de análise de decisões, por meio do qual foram examinados acórdãos do TJSP referentes à curatela e à tomada de decisão apoiada. Constata-se que mesmo com algumas divergências na aplicação do Estatuto e do Código Civil e diante da falta de disposições para melhor aplicar a TDA, as decisões reconheceram uma maior autonomia e possibilitar.
