Resumen de O critério determinante da filiação no caso de reprodução humana assistida com material biológico de terceiros

The application of assisted human reproduction techniques (ART) has been escalating vertiginously in Brazil, due to the amplitude of the universe of people who can make use of it. In particular, there is an increase in their demand for single people and homosexual couples. When biological material from third parties is used, there is dissociation between the biological truth and the legal truth. Besides the use of assisted reproduction techniques with heterologous material, there is also the situation in which the embryo is generated by a woman not involved in the parental project, the cases of pregnancy by substitution. This article aims to discuss the criteria to be applied to define the kinship bond to be established between the persons involved in the parental project and the child conceived, as we as the sufficiency or not of the rules established in the Brazilian legal system to solve the serious issues arising from the participation of third parties in assisted human reproduction techniques.

A aplicação das técnicas de reprodução humana assistida (TRA) cresce vertiginosamente no Brasil, em função da amplitude do universo de pessoas que dela podem fazer uso. Em particular, verifica-se o aumento de sua procura por pessoas solteiras e casais homoafetivos. Quando utilizado material biológico de terceiros, há dissociação entre a verdade biológica e a verdade jurídica. Além da utilização de técnicas de reprodução assistida com material heterólogo, há, também, a situação em que o embrião é gerado por mulher não envolvida no projeto parental, os casos de gestação por substituição. O presente artigo objetiva discutir os critérios a aplicar para definir o vínculo de parentesco a ser estabelecido entre as pessoas envolvidas no projeto parental e a criança concebida, bem como a suficiência ou não das regras postas no ordenamento jurídico brasileiro para solucionar as graves questões surgidas decorrentes da participação de terceiros nas técnicas de reprodução humana assistida.
