Ineficacia de las garantías constitucionales del juez constitucional latinoamericano, ante su procesamiento y destitución por el Congreso o Asamblea Legislativa

    Los casos de procesamiento y destitución de los miembros del Tribunal Constitucional o de la Corte Suprema de Justicia, por parte del Congreso o Asamblea Legislativa, son, en el contexto latinoamericano, un tema preocupante para la vigencia de la garantía de independencia del contralor de la constitución, y los derechos humanos del juez constitucional. Los hechos son similares: presiones de orden público y privado, la destitución sumaria de los jueces constitucionales por el Congreso (con amplia representación del partido oficialista), amparado en atribuciones constitucionales, y la denegación de justicia por los órganos de control constitucional interno. La Comisión y la Corte Interamericana de Derechos Humanos ("CIDH"), han manifestado (Cortázar, 2012), que este tipo de hechos vulneran las garantías fundamentales de independencia y autonomía del Tribunal Constitucional (Convención Americana de Derechos Humanos Artículo 25) y el derecho al debido proceso del cual deben gozar los jueces constitucionales (Convención Americana de Derechos Humanos Artículo 8.1).

    The cases of prosecution and dismissal of members of the Constitutional Court or the Supreme Court of Justice, by the Congress or Legislative Assembly, are, in the Latin American context, a matter of concern for the validity of the independence guarantee of the comptroller of the Constitution, and the human rights of the constitutional judge. The facts are similar: pressures of public and private order, summary dismissal of constitutional judges by the congress (with broad representation of the ruling party), protected by constitutional powers, and denial of justice by the internal constitutional control bodies. The Commission and the Inter-American Court of Human Rights (among other arguments) have stated that this type of acts violates the fundamental guarantee of independence and autonomy of the Constitutional Court (American Convention on Human Rights, Article 25) and due process of judges (American Convention on Human Rights Article 8.1).
