    Las resoluciones del Comité Europeo de Derechos Sociales son expresión directa de la Carta Social Europea y, consecuentemente, la naturaleza vinculante del tratado se extiende a dichas resoluciones. Dicha consecuencia viene impuesta por la Convención de Viena de 1969 y por la Constitución Española de 1978. Por tanto, el valor jurídico de las resoluciones del Comité significa su efectividad tanto a escala nacional (por parte de todos los poderes públicos -incluido el control de convencionalidad- y del conjunto de la ciudadanía) como a escala europea (por parte del Comité de Ministros y los demás órganos del Consejo de Europa). Obviamente, el cumplimiento obligatorio de la Carta y de las resoluciones del Comité supone una tarea crucial de formación, así como una actitud de honestidad y voluntad positiva por todos los actores implicados en garantizar los derechos sociales.

    The resolutions of the European Committee of Social Rights are a direct expression of the European Social Charter and, consequently, the binding nature of the treaty extends to these resolutions. Such consequence is imposed by the 1969 Vienna Convention and by the 1978 Spanish Constitution. Therefore, the legal value of the Committee's resolutions means their effectiveness both at nationa level (by all public authorities -including the control of conventionality-and byall citizens) and at European level (by the Committee of Ministers and the other Council of Europe's bodies). Obviously, binding obligations with regards to the Charter and the Committee's resolutions imply a crucial task of training as well as a behaviour of honesty and positive willingness on the part of all actors involved in guaranteeing social rights.
