Resumen de Rumbo a la Carta Social Europea: navegando en aguas procelosas hacia el reconocimiento de los derechos sociales y sus garantías

  Europa avanza hacia la Carta Social Europea. Las muestras son cada vez más numerosas. Se evidencian, por un lado, en el seno del Consejo de Europa. La más reciente es la aprobación por el Comité de Ministros, en la sesión que ha tenido lugar el 19 y 20 de mayo de 2022, de un Informe consolidado que recoge firmes medidas destinadas a mejorar la efectividad de los mecanismos de control de este tratado. Por otro lado, a nivel nacional de los Estados miembros, España ha sido paradigma en este sentido. Por fin, tras más de dos décadas, se ratificó en el año 2021 la Constitución Social de Europa y, en el mismo instrumento, se aceptó el procedimiento de reclamaciones colectivas. Este acontecimiento venía precedido de un progreso en la implementación, iniciado en el año 2013, localizado en la primera y segunda instancia judicial. Este no ha sido sencillo y, sigue sin serlo. La relevancia ganada continúa sin venir acompañada de una mayor consideración hacia el Tratado así como de la jurisprudencia del Comité Europeo de Derechos Sociales. Los cuestionamientos, oposiciones y recelos son constantes. El estudio pretende ilustrar sobre todos esos aspectos, y en él, obviamente se examinarán las dos primeras reclamaciones colectivas presentadas contra nuestro país. El objetivo que se pretende es el de seguir navegando en estas procelosas aguas hacia el reconocimiento de los derechos sociales y sus garantías.

  Europe is moving towards the European Social Charter. There are increasing signs of this. They are evident, on the one hand, within the Council of Europe. The most recent is the adoption by the Committee of Ministers, at its meeting on 19 and 20 May 2022, of a consolidated report containing decisive measures aimed at improving the effectiveness of the monitoring mechanisms of this treaty. On the other hand, at the national level of the Member States. Spain has been a paradigm in this regard. Finally, after more than two decades, the Social Constitution of Europe was ratified in 2021 and, in the same instrument, the collective complaints procedure was accepted. This development was preceded by progress in implementation, which began in 2013, at the first and second judicial instance. This has not been straightforward, and still is not. The gained relevance is still not accompanied by greater consideration of the Treaty and the case law of the European Committee of Social Rights. There is constant questioning, opposition and misgivings. This study aims to illustrate all these aspects. It includes, of course, the examination of the first two collective complaints lodged against our country. The aim is to continue navigating these stormy waters towards the recognition of social rights and their guarantees.
