El contexto actual de nuestro ordenamiento jurídico es calificado en muchas ocasiones como de “crisis del Derecho” o de debilitamiento de la capacidad regulativa del Derecho, donde tiene lugar un aumento de la relevancia de los instrumentos jurídicos “flexibles”, también denominados en ocasiones “soft”, capaces de adaptarse a contextos diversos y cambiantes. El presente artículo realiza una aproximación al fenómeno del soft law, a través de algunas de sus manifestaciones en nuestro ordenamiento jurídico y los efectos que comporta su inclusión en el mismo, especialmente respecto al principio de seguridad jurídica
The present context of our legal system is often described as “crisis of Law” or as the weakening of the regulatory capacity of the law, where the relevance of “flexible” juridical means, so called because of their capacity to adapt to diverse and changing environments and which are sometimes referred as “soft” too, is increasing. This article makes an approach to the phenomenon of soft law through some of its manifestations and the effects that come from its inclusion in our legal order, specially in regard to the principle of legal certainty.
