Resumen de A violência doméstica e a condição feminina: uma análise do acórdão do recurso especial nº 1.675.874 – ms

  This article is intended to comment on the judgment of Special Appeal No. 1,675,874 –MS, of the Superior Court of Justice, which characterized the moral damage in re ipsa, based on the condition of women. This decision proves to be paradigmatic, because when it brings together the civil and the criminal spheres, it presumes moral damage in cases of do-mestic violence against women. In an attempt to combat patriarchy rooted in the Brazilian soci-ety, thecourt presents the possibility that the Judiciary understands domestic violence as a way of maintaining gender inequalities and, therefore, an indemnifiable situation for perpetuating the condition of Brazilian women. When examining the minimum quantum ofdamages fixed in the judgment and the influence of “being a woman” in its measurement, it is possible to conclude that the damages were not sufficiently valued to break the cycle of domestic violence, which suggests a certain permanence of gender inequality

  O presente tem por objetivo comentar o acórdão do Recurso Especial nº 1.675.874 –MS, do Superior Tribunal de Justiça, que caracterizou o dano moral in re ipsa, com fundamento na condição feminina. Esta decisão mostra-se paradigmática, pois ao aproximar as esferas civil e penal, presume o dano moral em casos de violência doméstica contra a mulher. Na tentativa de combater ao patriarcalismo enraizado na sociedade brasileira, o julgado apresenta a possibilidade de que o Judiciário entenda a violência doméstica como forma de manutenção das desigualdades de gênero e, portanto, uma situação indenizável por perpetuar a condição da mulher brasileira.Ao se examinar o quantummínimo indenizatório fixado no acórdão e a influência do “ser mu-lher” na sua aferição, conclui-se que os danos não foram suficientemente valorados para romper o ciclo da violência doméstica, o que sugere certa permanência da desigualdade de gêneros.
