Las famosas tres posiciones de las bicicletas Brompton han planteado al Tribunal de Justicia la posibilidad de que el objeto de una patente caducada sea protegido a través del Derecho de autor. La respuesta del Tribunal de Luxemburgo a la cuestión perjudicial planteada permite hacer un recorrido por varios aspectos claves del Derecho de la Propiedad industrial e intelectual como son la excepción relativa a la función técnica y la acumulación de derechos. En este trabajo se aborda, al hilo del caso Brompton, la interptretación del Tribunal de Justicia sobre estas cuestiones en materia de marcas, diseño y Derecho de autor.
The possibility of protecting the object of an expired patent through Copiright have been brought up at the Court of Justice due to the famous three positions of the Brompton bicycles. The ruling of the ECJ allows us to cover several key aspects of Industrial and Intellectual Property Rights, such as the technical functionality exclusion and the cumulation of rights. Following on from the Brompton case, this paper aims to examine how the Court of Justice has interpreted these issues in trade mark, desing and copyright law.
