Las cuestiones complejas en los desahucios por precario en las cesiones gratuitas de vivienda a familiares

    Los padres en ocasiones ceden viviendas gratuitamente a sus hijos para que establezcan en ellas su domicilio conyugal. Tras la sentencia de separación o divorcio los padres interponen un juicio de desahucio por precario para recuperar la vivienda cedida. Frecuentemente la esposa del hijo se defendía alegando “cuestiones complejas” para conseguir que el juez archivara la demanda y se tuviera que iniciar otro proceso. En este trabajo analizaremos algunas de estas cuestiones que con la nueva ley de enjuiciamiento civil ya no permiten archivar el proceso pero que merecen especial atención.

    Parents sometimes cede housing free of charge to their sons and daughters so that they can establish their marital home there. After the separation or divorce judgment, the parents file an eviction lawsuit for precariousness in order to recover the assigned housing. Frequently the wife of the son defended herself by alleging "complex issues" in order to get the judge to file the lawsuit and another process would have to be initiated. In this paper we will analyze some of these issues which, with the new civil procedure law, no longer allow the process to be filed, but which deserve special attention.
