La inmatriculación por certificación eclesiástica

    La certificación expedida por el diocesano, con amparo al art. 206 de la Ley Hipotecaria de 1946, era un documento perfectamente válido y que salía al paso de una necesidad imperiosa, la de dotar de seguridad jurídica a muchas fincas que la iglesia poseía de manera continua, pacífica y públicamente, en especial de los templos destinados al culto, pero que adolecían de una seguridad jurídica, ya que aun siendo notorio su pertenencia al patrimonio de la Iglesia católica, se prohibía a ésta inscribirlos en el Registro de la Propiedad. Esta imposibilidad de inmatricular estos bienes hacía que la Iglesia católica estuviese en una posición de inseguridad y de desigualdad jurídica frente a otras confesiones religiosas que sí podían inmatricular sus bienes. Con esta certificación las autoridades eclesiásticas aportan seguridad jurídica a las tablas registrales del Registro de la Propiedad.

    The certification issued by the diocesan, under the protection of art. 206 of the Mortgage Law of 1946, was a valid document that satisfied an imperative need. It provided legal security to many properties that the church owned continuously, peacefully, and publicly, especially temples used for worship, but which lacked legal security, since even though they were notoriously part of the patrimony of the Catholic Church, the latter was forbidden to register them in the Land Registry. This impossibility to immatriculate these properties placed the Catholic Church in a position of legal uncertainty and inequality compared to other religious denominations that were able to immatriculate their properties. With this certification, the ecclesiastical authorities provide legal security to the registry entries in the Property Registry.
