Fundamentos y principios jurídicos básicos de la inteligencia artificial y el «big data»

    En este momento, existe una legislación proyectada por parte de la Unión Europea en materia de inteligencia artificial, contenida básicamente en la propuesta de reglamento de inteligencia artificial y en la propuesta de reglamento de responsabilidad civil sobre dicha materia. Del mismo modo, La Unión Europea está definiendo un nuevo marco normativo en materia de datos y big data, como el RGPD y al reglamento europeo de datos no personales, a los que ahora se añade la propuesta de reglamento en materia de gobernanza del dato y la propuesta de reglamento en materia de acceso justo y equitativo a los datos (ley del dato). Por tanto, habrá que esperar a la materialización de esta normativa para entender la profundidad y alcance de tales modificaciones, pero ahora podemos analizar los fundamentos y principios generales sobre los que se asienta la protección jurídica del Big Data y la inteligencia artificial, y ese es precisamente el contenido de este artículo.

    At this time, there is legislation projected by the European Union on artificial intelligence, basically contained in the proposal for a Regulation on artificial intelligence and in the proposal for a Regulation on civil liability on such matter. In the same way, the European Union is defining a whole set of regulations on data and big data, like RGPD or the Regulation on non-personal data, to which is now added the Proposal of Regulation on data governance and the proposal of regulation on fair data access and equity (Data Act). Therefore, we must wait for the materialization for all this to understand the depth and scope of such regulatory amendments, but now we can analyze the grounds and common principles on which the legal protection of Big Data and artificial intelligence is being founded, and this is precisely the content of this article.
