  The Judgement of the Italian Supreme Court ruling in Chambers on the Time Limit for “ Extended Confiscation ” ordered during the Execution Phase. The Italian Supreme Court ruling in chambers has been recently requested to solve the conflict concerning the determination of the maximum time limit of the so-called extended confiscation, pursuant to art. 240-bis of the Italian Criminal Code, when the measure is ordered during the execution phase. By endorsing the approach that provides a greater guarantee, limiting the identification of the assets that can be confiscated to the moment of the judgment of conviction (and not the time it becomes final), this ruling represents one more step in the process of setting a time limit to the measure implemented by both the Supreme Court and the Constitutional Court. Relying on grounds that underline several arguments supporting this position, the recent judgment contributes to the virtuous and progressive escalation of safeguards, aimed at making this legal institution consistent with its function, with the constitutional values, and with the supranational interpretation of the property right and its limitations.

  Di recente, le Sezioni Unite sono state chiamate a dirimere il contrasto insorto relativamente all'individuazione del confine temporale ultimo della c.d. confisca allargata, ex art. 240-bis c.p., ove questa sia disposta in sede esecutiva. Accogliendo l'orientamento più garantista, che limita al momento della sentenza di condanna — e non a quello dell'irrevocabilità della stessa — l'individuazione dei beni suscettibili di essere confiscati, la decisione in commento rappresenta una tappa ulteriore nel percorso di delimitazione temporale della misura messo in atto dalla giurisprudenza di legittimità e costituzionale: con una motivazione che evidenzia plurimi argomenti a sostegno della tesi accolta, la recente pronuncia contribuisce alla virtuosa e progressiva escalation di tutele volta a rendere tale istituto coerente rispetto alla funzione ad esso riconosciuta, ai valori costituzionali accolti dall'ordinamento, nonché alla lettura sovranazionale del diritto di proprietà e delle sue limitazioni.
