Resumen de El Acta Constitucional número 2 de 11 de septiembre de 1976 y la limitación del poder del general Pinochet a la luz de la doctrina de la constitución histórica

  El artículo se inserta en los estudios acerca de la dictadura cívico militar chilena y la caracterización del ejercicio del poder por parte del General Pinochet como limitado. Sostenemos que la tesis de las limitaciones cuenta también con una explicación construida desde el punto de vista histórico jurídico: se pueden entender como un caso de proyección de la doctrina indiana del buen gobierno. Estudiaremos el fenómeno en el contexto de la aprobación del Acta Constitucional número 2 de 1976 para sostener que el fenómeno de la limitación es comprensible a la luz de la tesis de la constituciónhistórica (que prescinde de la doctrina del constitucionalismo clásico).

  The article is inserted in the studies about the Chilean civic military dictatorship and the characterization of the exercise of power by General Pinochet as limited. We maintain that the thesis of limitations also has an explanation constructed from the legal historical point of view: they can be understood as a case of projection of the Indian doctrine of good governance. We will study the phenomenon in the context of the approval of Constitutional Act number 2 of 1976 to argue that the phenomenon of limitation is understandable in the light of the thesis of the historical constitution (which dispenses with the doctrine of classical constitutionalism).
