    Esta ponencia trata sobre la relación carismática y jurídica fundacional entre la Or-den de Santa Clara y la Orden de San Francisco: “quiero y prometo dispensaros siempre, pormí mismo y por medio de mis hermanos, y como a ellos, un diligente cuidado y una especialsolicitud”; y sobre la lucha de Clara por hacerla valer hasta conseguir plasmarla en la Regla.Estudiamos la causa y evolución de las tensiones sufridas a través de los siglos entre las dos ór-denes, hasta la ruptura no deseada de la unión jurídica, en España, a causa de la Exclaustraciónde las órdenes religiosas en el siglo XIX. Aunque la unión carismática siempre ha estado viva,planteamos finalmente la actual situación de de ruptura jurídica como un tema pendiente entrela I y II Orden, señalando el camino abierto por el D.C. para restaurar la unidad carismática yjurídica tal como fue querida por Francisco y Clara.

    This presentation deals with the charismatic and juridical-fundational relationshipbetween the Order of Saint Clare and the Order of Saint Francis: “I want and promise to offerto you always, on my own account and through my brothers, and as I do to them, diligent careand special concern”; and on Clare’s struggle to invoke and even to incorporate it in the Rule.We study the cause and the evolution of the tensions suffered across the centuries betweenthe two orders, up until the undesired severing of the juridical union, which in Spain occurredthrough the secularization of the religious orders in the 19th century. Though the charismaticunion has always remained alive, finally we raise the current situation of a juridical break as apending issue between the First and the Second Orders, indicating the way opened up by theD.C. for restoring the charismatic and juridical unit as it was desired by Francis and Clare.
