La terminología de diversidad sexual y de género se propone como una fórmula para que la ONU pueda aglutinar la multitud de realidades que se pretenden proteger a través del derecho antidiscriminatorio, que se encuentran vinculadas con comportamientos humanos que escapan del marco de la heteronormatividad. El presente estudio analiza, en el plano internacional, cómo la respuesta del mundo del derecho se ha ido modulando con base en la evolución de las reclamaciones de reconocimiento de diversidad sexual y de género. Así, se realizará un análisis de los últimos avances en el seno de más recientes en esta materia en el ámbito regional europeo. El tratamiento jurídico de estas realidades ha contribuido notablemente a una importante evolución del concepto mismo de discriminación, y éste será el hilo discursivo de análisis de esta aportación

The terminology of sexual and gender diversity is proposed as a formula that can be used to bring together the multitude of realities, in-tended to be protected through anti-discrimination law, which are linked to human behaviors outside the framework of heteronormativity. This study analyses, at the international level, how the response of the law has been modulated, based on the evolution of sexual and gender diversity recognition claims. Thus, following an analysis of the latest develop-ments within the UN, a study of the latest legislative and jurisprudential contributions in this area will be carried out at European regional level. The legal treatment of these realities has contributed significantly to an important evolution of the very concept of discrimination, and this will be the discursive thread of analysis of this contribution.
