En el presente trabajo se pretende el análisis de las instituciones del «affidamento » familiar en la legislación italiana y del acogimiento familiar en el ámbito normativo estatal de nuestro país, a través de las normas legales que han regulado dichas instituciones en el devenir de los años. Para su elaboración nos hemos remitido a los distintos posicionamientos doctrinales emitidos sobre el régimen jurídico de estas figuras en ambas normativas. Asimismo, el objetivo de este estudio es resaltar sus diferencias y semejanzas y realizar un juicio crítico sobre las normas en vigor, en un intento de mejorar su aplicación práctica y conseguir la finalidad última de proteger adecuadamente a los menores en situación de conflictividad socio-familiar.

In the present study the analysis of the institutions of the familiar «affidamento » in the Italian legislation and of the foster care in the state normative of our country is intended, through the legal norms that have regulated these institutions in the course of the years. For its preparation we have referred to the different doctrinal positions issued on the legal regime of normatives. In addition, the objective of this study is to highlight their differences and similarities and make a critical judgment on both legals, in an attempt to improve its practical application and achieve the ultimate goal of adequately protecting minors in situations of socio-family conflict.
