Resumen de Dimensiones de la responsabilidad penal de la persona jurídica: Anotaciones sobre la legislación ecuatoriana

  La responsabilidad penal de las personas jurídicas es un tema de mayor relevancia no sólo en el campo doctrinario, sino también en el legislativo. Para América Latina es relativamente nuevo, pues en la última década las legislaciones internas han estado adaptándose para incluir este tipo de responsabilidad en sus códigos penales, sobrepasando la esfera del Derecho administrativo sancionador. El presente estudio se ocupa de analizar las dimensiones dogmáticas de la responsabilidad penal de las personas jurídicas en un sentido amplio, ya que resulta importante el esclarecimiento de conceptos contrastando posturas, y estableciendo criterios propios que aporten a la literatura científica de la materia. Indudablemente sus principales influencias son la globalización del Derecho, el desarrollo de nuevas formas de criminalidad y la necesidad de determinar claramente la responsabilidad penal que se da el marco de la delincuencia (económica) al interior de las organizaciones empresariales. Finalmente hacemos unas breves consideraciones en cuanto a la legislación ecuatoriana y su postura en la implementación de la responsabilidad penal de la persona jurídica en el Código Orgánico Integral Penal desde el año 2014.

  The criminal liability of legal entities is a topic of greater relevance, not only in the field of doctrine, but also in the legislative field. For Latin America it is relatively new, since in the last decade the internal legislations have been adapting to include this type of responsibility in their penal codes, surpassing the sphere of sanctioning administrative law. This study analyses the dogmatic dimensions of the criminal liability of legal entities in a broad sense, because it is important to clarify concepts by contrasting positions and establishing criteria that contribute to the scientific literature on the subject. Undoubtedly, its main influences are the globalization of law, the development of new forms of criminality and the need to clearly determine the criminal liability that occurs within the framework of (economic) crime within business organizations. Finally, we make some brief considerations regarding the Ecuadorian legislation and its position in the implementation of the criminal responsibility of the legal entities in the Criminal Code since 2014.
