    Este trabajo analiza los aspectos más controvertidos de la cláusula testamentaria que prohíbe la intervención judicial en contiendas surgidas del testamento o de la participación hereditaria, cuando el recurso a la misma conlleva la atribución de la legítima estricta en detrimento del resto de la herencia en la que había sido instituido el legitimario, o la pérdida de testar para imponer este tipo de cláusulas, su disputa con la intangibilidad de la legítima, su configuración como Cautela Socini, su verdadera naturaleza jurídica, los criterios que determinan su aplicación o su inoperatividad, su confrontación con el derecho fundamental a la tutela judicial efectiva y su carácter de sanción.

    This work analyzes the most controversial aspects of the clause that prohibits judicial intervention derived from disputes arising with the will or hereditary partition, when the recourse to it entails the attribution of the testamentary institution of the voluntary heir. Specifically, the scope of the freedom to testify to impose this type of clause, its confrontation with the intangibility of the legitimate, its configuration as "cautela socini", its true legal nature, the criteria that determine its application or its inoperability, its conflict with the fundamental right to effective judicial protection and its character as a sanction.
