La función nomofiláctica a través del precedente jurisprudencial de la Signatura Apostólica

    En el marco más amplio de discusión sobre las virtualidades posibles del precedente judicial en la actividad jurisdiccional del Tribunal Supremo de la Signatura Apostólica, el presente trabajo se centra en ciertos aspectos de su jurisprudencia en términos de legitimidad y en su función fundamental de observancia exacta e interpretación uniforme de la ley. Al determinar la especificidad de algunas sentencias firmes en las que, hipotéticamente hablando, se podría encontrar la ratio decidendi asumida como supuesto indispensable del precedente, el artículo destaca algunas ventajas de poder juzgar en base al precedente. Partiendo específicamente del análisis de su actividad judicial, se ha podido identificar que el enjuiciamiento por precedente es por el momento un postulado de lege ferenda.

    Against the background of a broader discussion about the role of legal precedent in the jurisdiction of the Supreme Tribunal of the Apostolic Signatura, this paper focuses on certain aspects of its jurisprudence in terms of legitimacy and the exact observance and uniform interpretation of the law. Focusing on the specificity of some definitive sentences in which, hypothetically speaking, the ratio decidendi may be identified as an indispensable assumption of precedent, the paper emphasises some advantages of judgement based on precedent. Drawing on an analysis of its legal activity, it may be concluded that judgment via precedent is, for the time being, a principle of lege ferenda.
