    El presente trabajo cuestiona el tradicional entendimiento de los conceptos de daño y daño antijurídico a partir de las nociones de interés o bien jurídicamente tutelado. Bajo este enfoque, se busca mostrar cómo la influencia del Sistema Interamericano de Derechos Humanos en Colombia ubica en el núcleo de la tutela resarcitoria la noción de derecho subjetivo, y cómo los avances de la teoría jurídica aplicados a la responsabilidad extracontractual del Estado pueden tener esta última noción como un buen sustituto. A partir de estas consideraciones, se propone al lector una reinterpretación del daño y del daño antijuridico, así como una mirada renovada de instituciones como el daño moral y la pérdida de oportunidad y de la distinción habitual entre daño y perjuicio

    This paper questions the traditional understanding of the concepts of damage and unlawful damage based on the notions of interest or legally protected asset. In this sense, it is argued that the influence of the Inter-American System of Human Rights in Colombia has placed the notion of subjective rights at the core of the compensatory protection; and how the advances in legal theory applied to the non-contractual liability of the State can use this notion as a good substitute. Based on this understanding, a reinterpretation of the concepts of damage and unlawful damage is proposed, as well as a renewed look at moral damage, loss of opportunity, and the common distinction between damage and harm
