    Los socios significativos de las sociedades de capital encuentran en la Sentencia objeto de este comentario un incentivo para cuidarse de vender a plazos bienes inmuebles a las sociedades en que participan. No siempre, pero sí si concurren determinados condicionantes en dicha compraventa, el crédito por el precio aplazado será subordinado en caso de concurso de la sociedad compradora. Deja dudas al Alto Tribunal acerca de si dicha subordinación concursa! crediticia operará en todo caso si se trata de ventas a plazos de bienes muebles. Por último, es susceptible de discusión la analogía que la Sentencia comentada proyecta de contratos por su naturaleza jurídica, que no por su finalidad económica, al préstamo, a efectos de esta subordinación crediticia regulada hoy en el artículo 281.2-3º del Texto Refundido de la Ley Concursal.

    The significant partners of capital companies find in the sentence that is the subject of this paper an incentive to take care of selling real estates in installments to the companies in which they partícipae. Not _always, but yes 1f there are certain conditions in said sale, the credit for: the deferred price of these purchases wiII be subordinated in the event of bankruptcy by the buying company. The High Court leaves doubts about whether said bankruptcy subordination will operate in any case if it is about installment sales of movable property. Finally, the analogy that the commented sentence projects frorn contracts due to their legal nature, not due to their economic purpose, to the loan, for the purposes of this credit subordination regulated today in article 281.2-3º of the Consolidated Spanish text of the Bankruptcy Law.
