The paper proposes some remarks on the outcome of a first reading of the Italian new legislation on early repayment in the credit agreements for consumers in both the CCD and the MCD Directives. In particular, the reasons that justify — in the Italian legal system and in view of the forthcoming intervention of the EUCourt of Justice on the MCD Directive — the current very distinct legal treatment of up-front charges are highlighted in the two types of financing, such as some problems of the new criterion for calculating the operational early repayment in the silence of the credit agreement for consumers.
